This page covers how you can use our website, how estimates work, how project contracts are formed, what our warranty covers, and how disputes are handled. By using our site or working with us, you agree to these terms. Every active project is also governed by its own signed contract.
Acceptance of Terms
By accessing pacificstruct.com ("Website"), requesting an estimate, or entering into a service agreement with Pacific Evergreen Structures LLC ("PES," "we," "us," "our"), you agree to be bound by these Terms of Service ("Terms").
If you don't agree with any part of these Terms, please don't use our Website or request our services. We may update these Terms periodically, and your continued use of our Website or services constitutes acceptance of the updated Terms.
Our Services
PES provides design-build construction services across King and Snohomish County, Washington, including:
- Home additions, remodels, and renovations.
- Garage additions, rebuilds, and conversions.
- Decks (new, rebuild, repair, elevated, rooftop).
- Pergolas, sunrooms, and outdoor living structures.
- Commercial buildouts, tenant improvements, and property maintenance.
- Permit coordination and structural engineering coordination.
- Asbestos-aware demolition coordination (we do not perform abatement directly).
All services are subject to property eligibility, jurisdictional approval, scheduling availability, and our written project contract.
Free Estimates & Quotes
We provide free initial consultations and good-faith estimates based on the information you share with us. Estimates are not binding contracts and are subject to:
- On-site assessment and structural evaluation.
- Material costs and supplier availability at time of contract.
- Permit requirements determined by the relevant city or county.
- Unforeseen site conditions discovered during construction (e.g., asbestos, structural issues, electrical/plumbing problems concealed in walls).
- Scope changes requested by you after contract signing.
Estimates remain valid for 30 days from issuance unless otherwise stated. A binding price is established only through a signed written contract.
Project Contracts
Every project begins with a written contract that includes:
- Scope of work — detailed description of materials, dimensions, finishes, and deliverables.
- Total price — fixed price or detailed allowance schedule.
- Payment schedule — milestone-based draws tied to project progress.
- Timeline — start date, expected completion, and contingency clauses for delays beyond our control.
- Warranty terms — specific to your project type and materials.
- Change order procedures — how scope or price changes are handled in writing.
The signed contract — not these Terms or any web content — controls the specific obligations between you and PES for your project.
Permits & Code Compliance
PES coordinates and submits permits as part of most projects. You agree that:
- Permit timelines are controlled by the local jurisdiction and not by PES.
- You will provide accurate property information, deeds, surveys, and homeowner association consents as needed.
- Permit fees, plan-review fees, and impact fees imposed by the city or county are billed in addition to the contract amount unless specifically included.
- Permits may reveal additional code compliance requirements (e.g., egress, fire separation, energy code) that affect cost and timeline.
For projects on homes built before 1981, a Good Faith Inspection may be required before demolition or disturbance of suspect materials. Pacific Evergreen Structures does not perform asbestos abatement directly. If asbestos-containing material is identified, testing and abatement must be performed by separately licensed professionals, and any related cost or schedule impact is handled outside the base construction scope unless specifically included in the written contract.
Warranty
PES provides a written 1-year workmanship warranty on every project, beginning at substantial completion. The warranty covers defects in our construction workmanship under normal use conditions.
Not covered by the workmanship warranty:
- Normal wear, settling, shrinkage, fading, or cosmetic changes.
- Damage caused by weather events, water intrusion from external sources, or natural disasters.
- Damage caused by you, your tenants, third-party contractors, or improper maintenance.
- Materials, fixtures, or appliances — these carry their own manufacturer warranties, which we pass through directly to you.
- Pre-existing conditions not part of our scope of work.
Specific warranty terms may vary by project scope and material type and will be detailed in your project contract. To make a warranty claim, contact us within the warranty period in writing.
Payment & Cancellation
Payment terms are governed by your signed project contract. Generally:
- Payment schedules are milestone-based, tied to specific construction completion points.
- Late payments may incur interest at the rate permitted by Washington law and may pause work until brought current.
- Accepted payment methods include check, bank transfer, and approved credit options as specified in the contract.
- Cancellation rights and refund procedures are governed by your contract and applicable Washington consumer protection law.
Under Washington law, you have the right to cancel certain contracts within three (3) business days of signing. Your specific cancellation rights will be disclosed in your contract.
Website Use
You agree to use pacificstruct.com only for lawful purposes. You will not:
- Attempt to gain unauthorized access to any part of the Website, our servers, or our internal systems.
- Use the Website to transmit malicious code, viruses, or harmful content.
- Submit false or misleading information through any form.
- Copy, scrape, or systematically reproduce content from the Website without written permission.
- Use the Website in any way that could damage, disable, overburden, or impair its operation.
We may suspend or terminate your access to the Website at any time, without notice, for any violation of these Terms.
Intellectual Property
All content on pacificstruct.com — including text, logos, photography, 3D renderings, design concepts, and the website code itself — is owned by Pacific Evergreen Structures LLC or licensed for our use. It's protected by copyright, trademark, and other intellectual property laws.
You may view, download, and print our content for personal, non-commercial use only. Republishing, reselling, or modifying any of our content without written permission is prohibited.
Photos of your project: unless you opt out in writing before construction, we may photograph completed work and use it in our portfolio, on our website, and in marketing materials. No personally identifying details (your name, exact address) will be published without your explicit permission.
Disclaimers
Our Website is provided "as is" and "as available." While we work hard to keep our content accurate and up-to-date, we cannot guarantee:
- That information about timelines, pricing, or product specifications is current. Material costs, permit timelines, and availability change.
- That photographs of past projects represent the exact result for a different property.
- That the Website will be available without interruption or error.
- That third-party links (Google, Yelp, suppliers) lead to accurate or up-to-date content.
Nothing on the Website constitutes legal, financial, or engineering advice. Project-specific recommendations are provided only after on-site consultation and only via a signed contract.
Limitation of Liability
To the maximum extent permitted by Washington law, PES shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages arising from your use of the Website.
- Loss of profits, business opportunities, or anticipated savings.
- Damages exceeding the amount you paid us for the specific service in question.
This limitation does not affect statutory rights you may have as a consumer under Washington law, including rights under the Washington Consumer Protection Act.
Indemnification
You agree to indemnify and hold PES (and our employees, agents, and subcontractors) harmless from any claims, damages, or expenses arising from:
- Your violation of these Terms or your project contract.
- Inaccurate information you provided to us.
- Disputes with neighbors, HOAs, or other third parties regarding work performed at your property.
- Your misuse of completed work or failure to maintain it properly.
Dispute Resolution
We believe most disputes can be resolved through honest, direct conversation. Before initiating formal proceedings, you agree to:

- Allow 30 days — for us to investigate and propose a resolution.
- Mediation — if direct resolution fails, both parties agree to attempt good-faith mediation through a mutually agreed mediator in King County, WA, before initiating litigation.
Nothing in this section limits your right to file a complaint with the Washington State Department of Labor & Industries Contractor Section, which licenses and regulates contractors statewide.
Governing Law & Jurisdiction
These Terms and any related disputes are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any legal action arising from these Terms or our services must be brought in the state or federal courts located in King County, Washington.
Updates to These Terms
We may revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The "Last Updated" date at the top of this page reflects the most recent revision.
For material changes, we will provide notice on our Website. Active project contracts are not affected by Terms updates — they're governed by the specific terms in effect when the contract was signed.
